Welcome to Equals2. These Terms of Service ("Terms") govern your access to and use of the Equals2 website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Equals2 is a subscription-based educational platform providing CAPS-aligned mathematics practice for children in Grades 1 to 12 in South Africa. The Service is intended for use by parents or legal guardians ("you" or "Parent") on behalf of their children.

1. Definitions

"Account" means your registered parent account on Equals2.

"Child Profile" means a profile created by a Parent within their Account for a specific child.

"Content" means all questions, assessments, diagnostic reports, practice tests, and educational materials available through the Service.

"Free Trial" means the limited free diagnostic assessment available without a paid subscription.

"Subscription" means a paid plan (Solo, Duo, Family, or Lifetime) that provides access to the full Service.

2. Eligibility and Account Registration

You must be at least 18 years old and a resident of South Africa to create an Account. By registering, you represent that you are the parent or legal guardian of any child for whom you create a Child Profile.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You must notify us immediately at support@equals2.co.za if you become aware of any unauthorised use of your Account.

You agree to provide accurate and complete information during registration and to keep this information up to date.

3. Free Trial

Equals2 offers a free diagnostic assessment consisting of 10 questions (2 per topic across 5 CAPS content areas). The Free Trial is available without creating an Account. You may complete up to 3 free diagnostic attempts, for any grade and term combination.

The Free Trial is provided to allow you to evaluate the Service before subscribing. No payment information is required for the Free Trial. Free Trial usage is tracked locally on your device.

4. Subscriptions and Payment

4.1 Plans

Equals2 offers the following subscription plans:

Monthly and annual billing cycles are available for Solo, Duo, and Family plans. Pricing is displayed in South African Rand (ZAR) on our website and may be updated from time to time with at least 30 days' notice to existing subscribers.

4.2 Payment Processing

All payments are processed through PayFast (Pty) Ltd, a registered South African payment service provider. By subscribing, you also agree to PayFast's terms of service. We do not store your credit card or banking details — these are handled entirely by PayFast.

4.3 Billing

Monthly subscriptions are billed on the same date each month as your initial subscription date. Annual subscriptions are billed once per year on your subscription anniversary date. Lifetime plans are a single, one-time payment.

4.4 Price Changes

We may adjust subscription pricing from time to time. Existing subscribers will receive at least 30 days' written notice (via email) of any price increase. The new price will take effect from your next billing cycle after the notice period. If you do not agree to the new pricing, you may cancel your subscription before the new price takes effect.

5. Cooling-Off Period and Cancellation

5.1 Cooling-Off Period

In accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), you have the right to cancel your subscription within 7 (seven) days of your initial subscription date, without penalty and for any reason. To exercise this right, send a written cancellation request to support@equals2.co.za within the 7-day period. A full refund will be processed within 15 business days.

5.2 Cancellation After Cooling-Off Period

You may cancel your monthly or annual subscription at any time by emailing support@equals2.co.za with at least 20 (twenty) business days' notice, as required under Section 14 of the Consumer Protection Act 68 of 2008. Upon cancellation:

5.3 Lifetime Plans

Lifetime plans may be cancelled within the 7-day cooling-off period for a full refund. After the cooling-off period, Lifetime plans are non-refundable, as they represent a one-time purchase of ongoing access. "Lifetime" means for the duration that the Equals2 Service remains in operation.

5.4 Refunds

Refunds are processed to the original payment method via PayFast. Processing may take up to 15 business days from the date we confirm your cancellation.

6. The Service

6.1 Diagnostic Assessments

Paid subscribers receive access to a full 50-question diagnostic assessment per child, covering 5 CAPS content areas (10 questions per topic). Diagnostics are designed to be completed over 5 sessions (1 topic per session). Each diagnostic must be completed within 7 days of starting, or it resets. The diagnostic term is automatically selected based on the South African school calendar.

6.2 Practice Tests

Upon completing a diagnostic, subscribers gain access to CAPS-weighted practice tests. The number of questions per test varies by grade level (Grades 1–3: 20 questions, Grades 4–6: 25 questions, Grades 7–9: 30 questions, Grades 10–12: 35 questions).

6.3 AI-Generated Personalised Questions

We may offer personalised practice questions generated using artificial intelligence, tailored to areas where your child needs improvement. This feature is subject to usage limits per child per month. AI-generated content is reviewed for curriculum alignment but is provided as supplementary practice and does not replace the core CAPS-aligned question bank.

6.4 Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our reasonable control. We will endeavour to provide advance notice of planned downtime.

7. Child Profiles and Parental Responsibility

Children do not create their own accounts. All Child Profiles are created and managed by the Parent through their Account. You are solely responsible for supervising your child's use of the Service.

By creating a Child Profile, you confirm that you are the parent or legal guardian of the child and that you consent to the processing of the child's personal information as described in our Privacy Policy, in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

Child Profile information is limited to: nickname (not required to be the child's real name), avatar selection, grade level (1–12), and assessment performance data.

9. Intellectual Property

All Content, including questions, assessments, reports, graphics, logos, and software, is the property of Equals2 (or its licensors) and is protected by South African copyright law and international intellectual property conventions. Your subscription grants you a limited, non-exclusive, non-transferable licence to access and use the Content for personal, non-commercial educational purposes only.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any Content without our prior written consent.

10. Disclaimer and Limitation of Liability

Equals2 is a supplementary educational tool. We do not guarantee specific academic outcomes, test scores, or improvements in school performance. The Service is not a substitute for classroom instruction, professional tutoring, or any form of certified education.

To the maximum extent permitted by South African law:

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under South African law, including liability for fraud or gross negligence.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information and your child's personal information in compliance with POPIA. By using the Service, you confirm that you have read and understood the Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The "Last Updated" date at the top indicates when the most recent changes were made.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute by contacting us at support@equals2.co.za. We will attempt to resolve the matter within 30 days. If we cannot reach a resolution, either party may pursue further remedies under applicable law, including lodging a complaint with the National Consumer Commission.

14. Suspension and Termination

We may suspend or terminate your Account immediately if you breach these Terms, if we are required to do so by law, or if we reasonably determine that your Account activity poses a risk to the Service or other users. Where reasonably practicable, we will give you notice and an opportunity to remedy the breach before termination.

Upon termination, your right to access the Service ceases immediately. We may retain your data as required by law or for legitimate record-keeping purposes, as detailed in our Privacy Policy.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Equals2 regarding the Service.
